Terms of Use — Focus Weather

These terms govern your use of Focus Weather (the “App”), an iOS and Apple Watch app by Waruna de Silva (“we”, “us”). By downloading or using the App, you agree to these terms. The App is also subject to Apple's Standard End User License Agreement (EULA); where these terms and Apple's EULA differ, Apple's EULA governs your license to use the App.

License

We grant you a personal, non-exclusive, non-transferable license to use the App on Apple devices that you own or control, in accordance with Apple's App Store Terms and these terms.

Free features & Premium

Focus Weather is free to download and use. Three weather moods and the core Pomodoro timer are free, forever. Focus Weather Premium unlocks all twelve animated weathers and every ambient soundscape. Premium is available in two ways:

Premium (yearly) — an auto-renewable subscription that starts with a 7-day free trial, then renews at the price shown in the App (US $2.99 per year; prices in other regions are set by Apple and shown before purchase).
Lifetime unlock — an optional one-time, non-consumable purchase that unlocks Premium permanently with no subscription.

Auto-renewable subscription terms

The following applies to the Premium (yearly) subscription:

Title: Focus Weather Premium. Length: 1 year (auto-renewing). Price: US $2.99 per year, following a 7-day free trial.
Payment is charged to your Apple Account at confirmation of purchase.
The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage your subscription and turn off auto-renew in your Apple Account settings (Settings → your name → Subscriptions) after purchase.
If you buy the subscription during a free trial, any unused portion of the trial is forfeited when the purchase is made, where applicable.

Purchases are processed by Apple and tied to your Apple Account; you can restore them on your devices at any time. Refunds are handled by Apple under their policies.

Acceptable use

You agree not to reverse engineer, modify, resell, or otherwise misuse the App except as permitted by law. The App is a focus and productivity aid; it is not medical, health, or professional advice.

Intellectual property

The App, its name, design, and content are owned by us and protected by applicable laws. These terms do not grant you any rights to our trademarks or branding.

Disclaimer & limitation of liability

The App is provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Nothing in these terms limits liability that cannot be limited under applicable law.

Changes

We may update the App and these terms from time to time. Continued use after an update means you accept the revised terms. Material changes will be reflected by the date above.
